Terms of Service

These Terms of Service (Terms) govern your use of the Pickets Property Search Companion application and website (Pickets, the Service), operated by Harrison Grant Balding as a sole trader (ABN 77 351 820 901).

By creating an account or using Pickets, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

These Terms are governed by the laws of New South Wales, Australia.

What Pickets is

Pickets is an inspection assistance tool that:

• guides you through a structured property walkthrough
• records your observations
• calculates a quality score based on your responses
• generates a plain-English summary using AI

What Pickets is not

Pickets is not:

• a licensed buyer's agent
• a licensed building inspector
• a structural engineer
• a pest inspector
• a conveyancer or solicitor
• a financial advisor

Nothing in Pickets constitutes professional advice. Inspection scores, AI-generated summaries, and question sets are based entirely on your own observations and are provided for informational purposes only.

Pickets does not make recommendations. All outputs use language such as "indicates", "suggests", or "flags" and are provided for informational purposes only.

Pickets does not replace:

• a professional building inspection
• a pest inspection
• a strata report
• legal or financial advice

You must always obtain independent professional inspections before making any property purchase decision.

To use Pickets, you must:

• be at least 18 years old
• be located in Australia
• create an account using accurate information

You may not create an account on behalf of another person without their consent.

You are responsible for:

• maintaining the confidentiality of your login credentials
• all activity that occurs under your account

You must not:

• share your account with others
• impersonate another person
• use false information

We may suspend or terminate your account if you breach these Terms.

Free inspection

Each new account receives one free inspection. It is non-transferable.

Inspection credits

• Cost: $9 AUD (GST-inclusive)
• One credit = one inspection
• Credits do not expire

Season Pass

• Cost: $49 AUD (GST-inclusive)
• Unlimited inspections for 90 days
• Expires automatically at the end of the 90-day period

When credits are consumed

Credits and Season Pass entitlements are consumed when you start an inspection. If you abandon an inspection after starting it, the credit is consumed.

Payments

All payments are processed by Stripe. By paying, you agree to Stripe's terms. All prices are in Australian dollars and include GST.

We provide refunds only in the following situations:

Technical failure

If an inspection cannot be completed due to a technical error on our side, we will restore the consumed credit.

Duplicate charge

If you are charged more than once for the same transaction, we will refund the duplicate amount.

AI summary failure

If the AI summary fails to generate, your inspection data is still saved and accessible. No automatic refund is provided for AI summary failure alone. However, at our discretion, we may issue a replacement inspection credit where the failure was caused by a technical error on our part. To request consideration, contact harry@pickets.app.

No refunds for:

• change of mind
• unused credits
• expired Season Passes
• abandoned inspections

Your rights under the Australian Consumer Law (ACL) are not affected.

To request a refund, email harry@pickets.app with your account email and details of the issue.

Pickets is provided for personal, non-commercial use only. Use of Pickets for commercial property assessment, competitor research, or any revenue-generating activity is prohibited without our prior written approval. Contact harry@pickets.app to discuss commercial arrangements.

You must not:

• use Pickets for unlawful purposes
• attempt to access data belonging to other users
• use bots, scrapers, or automated tools
• reverse engineer or attempt to extract source code
• interfere with or disrupt the Service
• misrepresent your identity
• use Pickets to collect information about others

We may suspend or terminate your account for unacceptable use.

All content, design, code, question sets, scoring logic, and AI prompts within Pickets are the intellectual property of Harrison Grant Balding.

You may not copy, reproduce, distribute, or create derivative works without written permission.

Your data

Your inspection data (responses, notes, scores) belongs to you. We do not claim ownership of your inspection data.

You grant us a licence to store, process, and display your inspection data solely for the purpose of operating the Service.

Our handling of your personal information is governed by our Privacy Policy, which forms part of these Terms.

By using Pickets, you agree to the Privacy Policy.

We will never sell or disclose your inspection data or personal information to real estate agents, vendors, property managers, or any party with a commercial interest in the properties you inspect.

Personal information is retained only for as long as your account is active. On account deletion, your personal data is removed from active systems immediately. Full details of our data retention and deletion practices are set out in our Privacy Policy at pickets.app/privacy.

To the maximum extent permitted by law, Pickets is provided as is and as available.

We do not warrant that:

• the Service will be uninterrupted, error-free, or secure
• inspection scores or AI outputs will be accurate, complete, or reliable
• the Service will identify all defects or issues with any property

Nothing in these Terms excludes or modifies consumer guarantees under the Australian Consumer Law.

Pickets does not hold any professional licence in building inspection, pest inspection, structural engineering, strata management, conveyancing, law, or financial advice.

Nothing in the Pickets application constitutes professional advice of any kind. No professional duty of care is created between Pickets and any user by virtue of using the Service.

You acknowledge that Pickets is an observation and guidance tool only, and that any reliance on Pickets outputs for the purpose of making a property purchase decision is made entirely at your own risk.

To the maximum extent permitted by law:

• our total liability for any claim is limited to the amount you paid us in the 12 months before the claim
• we are not liable for any loss arising from your reliance on Pickets outputs
• we are not liable for property purchase decisions made using Pickets
• we are not liable for defects or issues not identified during a Pickets inspection
• we are not liable for indirect, consequential, or special damages

These limitations do not apply where they cannot be limited under Australian law.

You agree to indemnify and hold harmless Harrison Grant Balding from any claims, losses, or expenses (including legal fees) arising from:

• your use of the Service
• your breach of these Terms
• your misuse of Pickets outputs

Pickets integrates with third-party providers including:

• Stripe (payments)
• Anthropic (AI outputs)
• Supabase (database and hosting)
• PostHog (analytics)
• Google (address autocomplete)

Your use of these services is subject to their terms and privacy policies. We are not responsible for their content or practices.

We may modify, suspend, or discontinue any part of Pickets at any time.

We may update these Terms from time to time. For material changes, we will notify you by email before the changes take effect.

Your continued use of Pickets constitutes acceptance of updated Terms.

We may take the Service offline periodically for scheduled maintenance, updates, or improvements. Where possible, we will provide advance notice of scheduled downtime via email or in-app notification.

Unscheduled outages may occur due to circumstances beyond our control. We will use reasonable efforts to restore the Service as quickly as possible.

We are not liable for any loss or inconvenience caused by scheduled or unscheduled downtime. No refunds or credits are issued for downtime periods unless caused by a sustained outage exceeding 72 hours, in which case we may issue a replacement credit at our discretion.

You may delete your account at any time via the Account screen. Unused credits and unexpired Season Passes are non-refundable on voluntary termination.

We may suspend or terminate your account if you breach these Terms.

Upon termination, your right to use Pickets ends immediately.

These Terms are governed by the laws of New South Wales, Australia.

Any dispute must first be raised with us at harry@pickets.app. We will respond within 5 business days.

If unresolved, disputes are subject to the exclusive jurisdiction of the courts of New South Wales.
